Я так понимаю, срок устранения недостатков товара (т.е. ремонта телефона) был не только оговорен, но и определен соглашением сторон в письменной форме.
Тогда в соответствии с ФЗ «О защите прав потребителей» в случае просрочки выполнения требований по устранению недостатков товара продавец уплачивает пеню в размере 1% цены товара за каждый день просрочки. При этом стороны могут заключить соглашение о новом сроке устранения недостатков товара. Также потребитель вправе предъявить, а продавец обязан выполнить иные требования, предусмотренные ст.18 настоящего закона (замена товара, соразмерное уменьшение цены и др.). Независимо от выполнения или невыполнения условий договора о сроках устранения недостатков товара продавец по требованию потребителя обязан в трехдневный срок безвозмездно предоставить на период ремонта аналогичный товар, обеспечив доставку за свой счет.
